Welcome to VIP Days Australia (“us”, “we”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website vipdays.com.au (the “Website”) and any related services provided by us (collectively, the “Services”).

By accessing or using the Services, you (“you” or “User”) agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Services.

• “Expert” refers to a registered user who provides VIP Day services and has a profile listed on the Website.
• “Offer” refers to a VIP Day service package listed by an Expert on the Website.
• “User” refers to any individual or entity that accesses or uses the Services.
• “Website” refers to the website accessible at vipdays.com.au.

3. User Accounts

• To access certain features of the Services, you may be required to create a User account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.  
• You agree to provide accurate and complete information when creating your account and to keep your information updated.  
• We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms.  

4. Expert Listings

• Experts are responsible for the accuracy and completeness of the information provided in their profiles and offers.
• All listings are subject to review and approval by VIP Days Australia.
• We reserve the right to decline or remove any listings that do not meet our quality standards or violate these Terms.
• Experts are solely responsible for the delivery and quality of their VIP Day services.

5. User Conduct

• You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Services by, any third party.  
• You agree not to upload, post, or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.  
• You agree not to impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.  

6. Intellectual Property

• The Services and their original Content, features, and functionality are and will remain the exclusive property of VIP Days Australia.  

7. Consumer Guarantees and Refunds

• If you are a consumer under the Australian Consumer Law, you may have certain rights and remedies in relation to the Services, including guarantees that cannot be excluded, restricted, or modified. These Terms do not attempt to exclude, restrict, or modify those rights and remedies.
• If you are not a consumer under the Australian Consumer Law, then to the maximum extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities, and other terms implied or conferred by statute, custom, or the general law that impose any liability or obligation on VIP Days Australia are excluded.  
• Where you are a consumer under the Australian Consumer Law, and the Services are not of a kind ordinarily acquired for personal, domestic, or household use or consumption, our liability for any breach of a guarantee that cannot be excluded is limited, at our option, to:

• the supplying of the Services again; or
• the payment of the cost of having the Services supplied again.  

• Refunds for VIP Day services are subject to the individual Expert’s refund policy. Please refer to the Expert’s profile or contact them directly for details.

8. Disclaimer

• Except as expressly provided in these Terms, to the maximum extent permitted by law, the Services are provided “as is” and “as available” without any warranties of any kind, either express or implied.
• We do not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services or the server that makes them available are free of viruses or other harmful components.  

9. Limitation of Liability

• Subject to clause 7 and to the maximum extent permitted by applicable law, in no event shall VIP Days Australia, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or your inability to access or use, the Services.  

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.  

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be settled amicably through mutual discussion. If the dispute cannot be resolved amicably, it shall be submitted to the exclusive jurisdiction of the courts of Australia.

12. Changes to These Terms  

We reserve the right to modify these Terms at any time in our sole discretion. If we make material changes to these Terms, we will post the updated Terms on the Website and update the “Last updated” date at the top of this page.
